Welcome to WhoDat™! These Terms of Service ("Terms") govern your use of the WhoDat mobile application ("App") and any related services provided by WhoDat Ventures, Inc. ("WhoDat," "we," or "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional guidelines, rules, and policies that may be provided by WhoDat.
WhoDat is a mobile application that helps users search and discover people using photos or names. However, please note that the App does not always guarantee accurate results and may occasionally display incorrect information. The accuracy and availability of data may vary depending on various factors, including but not limited to the information available and provided by users. We recommend verifying the information through multiple sources before relying on it. WhoDat is not responsible for any inaccuracies or outdated information.
The App may contain links to third-party websites or display content from third parties. WhoDat is not responsible for the accuracy, legality, or appropriateness of such third-party content. Any interaction or transaction you undertake with third parties through the App is solely between you and the third party, and WhoDat shall have no liability for any damages or losses arising from such interactions. You are advised to review the terms and privacy policies of any third-party websites or services that you access through the App.
WhoDat allows users to submit and share content, including but not limited to photos, comments, and profiles ("User Content"). By submitting User Content, you grant WhoDat a non-exclusive, royalty-free, worldwide, perpetual, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with the App. You represent and warrant that you have the necessary rights and permissions to grant this license to WhoDat.

WhoDat Ventures, Inc. ("WhoDat") provides users the ability to request and utilize custom URL shortlinks, also known as WhoDat Handles™, to facilitate easier identification and access to their profiles on the WhoDat platform. These custom URL shortlinks are provided as a convenience and must be used responsibly and ethically. By using WhoDat’s custom URL shortlink feature, you agree to the following conditions:

In the event WhoDat determines, in its sole discretion, that you are misusing a custom URL shortlink, WhoDat reserves the right to take one or more of the following actions:
WhoDat Ventures, Inc. reserves the right to modify or discontinue the custom URL shortlink feature at any time, without notice, and at its sole discretion.
By continuing to use the custom URL shortlink feature, you acknowledge and agree to abide by these terms. Failure to comply with these terms may result in actions being taken by WhoDat Ventures, Inc. as outlined above, up to and including termination of your access to the WhoDat platform.
All intellectual property rights in the App, including but not limited to trademarks, copyrights, patents, and trade secrets, are owned by WhoDat or its licensors. You agree not to reproduce, modify, distribute, or create derivative works from any content on the App without the prior written consent of WhoDat.

WhoDat reserves the right to modify or amend these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the App. By continuing to use the App after such modifications, you agree to be bound by the revised Terms.
WhoDat may terminate or suspend your access to the App at any time, with or without cause, and without prior notice or liability. Upon termination, all provisions of these Terms that by their nature should survive termination shall remain.
The App and its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. WhoDat does not warrant that the App will be error-free, uninterrupted, or free from viruses or other harmful components. You agree that your use of the App is at your sole risk.
To the maximum extent permitted by applicable law, WhoDat and its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with your use of the App.
These Terms shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of laws principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the state of Delaware.
These Terms constitute the entire agreement between you and WhoDat regarding the use of the App, superseding any prior agreements or understandings. Any failure by WhoDat to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid to the fullest extent permitted by law.
